INTRODUCTION

This document, together with the legal notices, establishes the terms and conditions for booking travel and other services offered (hereinafter, the “Terms”).

Please read the Terms carefully before making any transaction. By using this website or placing an order through it, you agree to be bound by these Terms. If you do not agree to all of the Terms, you should not use this website.

These Terms may be modified. It is your responsibility to read them periodically, as the Terms in effect at the time of using the website or placing an order will be the ones applicable to you.

By using this website and/or placing orders through it, you agree to: 

1. Use the services only to make legally valid inquiries or reservations. 

2. Not carry out any false or fraudulent transactions. If we reasonably believe that a transaction of this nature has been carried out, we are authorized to cancel it and inform the relevant authorities. 

3. Provide us with your email address, postal address, payment information, and/or other contact details truthfully and accurately. You also consent to our use of this information to contact you if necessary (see our privacy policy). 

If you do not provide us with all the information we need, we will not process your selected transactions.

By making an inquiry or requesting services through this website, you declare that you are over 18 years of age and have the legal capacity to enter into contracts. 

RESERVATIONS THROUGH OUR WEBSITE

To make any travel reservation or book any other service offered by Astrotouristing, you must select a valid payment method, authorizing us to process charges using that selected payment method. 

All transactions are subject to the User reading and accepting these General Booking Conditions. Once these conditions, as well as the terms and conditions applicable to the reservation and purchase of the selected product, have been accepted and the corresponding payment has been made, we will complete the transaction as soon as possible. 

In the event that, due to certain circumstances, we are unable to complete the orders placed, we will notify you as soon as possible. 

PRICES AND PAYMENT METHODS

All prices offered on our website are in EUROS (EUR). The purchase and sale of virtual currencies is not subject to VAT; however, any tax obligations that may arise from the ordered transactions are your sole responsibility.

Payments and refunds for all transactions will be made in euros (EUR). If your credit/debit card is not denominated in EUROS, the exchange rate will be applied by your bank according to the market rate and may differ from the price shown on our website.

In the case of package holidays, the price of the package holiday has been calculated based on currency exchange rates, transportation fares, fuel costs or other energy costs, taxes, and other tourist surcharges, including those for landing, embarkation, and disembarkation at ports and airports if expressly included, applicable on the date the pre-contractual information is provided.

Unless otherwise indicated, the program offer reflects prices per person based on accommodation in a standard double room and flights in economy class.

Any variation in the price of these elements may result in a revision of the final trip price, either upward or downward, by the exact amount of the price variations mentioned. These modifications will be notified to the traveler in writing. Price revisions, in accordance with Article 158 of Royal Legislative Decree 1/2007 of November 16, which approves the Consolidated Text of the General Law for the Defense of Consumers and Users and other complementary laws, will only take place if the tour operator has expressly reserved this right and has communicated it to the traveler in the pre-contractual information provided before booking. 

Under no circumstances will the price of the trip be increased in the 20 days immediately preceding the departure date. If the price increase exceeds eight percent of the package tour price, the traveler may terminate the contract by notifying the organizer.

All payments and refunds will be processed in euros (EUR). If your credit/debit card is not denominated in euros, the exchange rate will be applied by your bank according to the market rate and may differ from the price shown on our website.

The payment methods available on our website will be displayed during the booking process.

Astrotouristing will always use secure payment methods. Astrotouristing will not store any information regarding the details of the cards used. By using a debit/credit card, the user confirms that the card used belongs to them or that they have been duly authorized by the cardholder to use it. Credit/debit card transactions are subject to security checks and validation by the card issuer. If the card issuer declines the transaction, Astrotouristing will not be responsible for any delays or cancellations. When payments are made by credit or debit card, any fees or commissions charged to Astrotouristing by the payment service provider are the sole responsibility of the customer. 

ORDER CONFIRMATION

Orders are subject to acceptance by Astrotouristing, the user's compliance with and acceptance of the GENERAL BOOKING CONDITIONS, and market availability. Astrotouristing reserves the right to refuse an order if payment information is not approved or if any other issue related to the portal's General Terms of Use is detected. When you make a purchase through our website, we may send you a confirmation email with transaction details. Please verify that the details in the confirmation message are correct as soon as possible and keep a copy for your records. 

RIGHT OF WITHDRAWAL

Transactions made on our website include trips, activities, and tourist services contracted directly with various suppliers and tour operators. All of these are subject to the right of withdrawal under the terms and conditions of return established by the service provider in the package travel contract or the purchase of individual services, as applicable. You will be informed of these terms and conditions before accepting payment. 

OUR RIGHT TO MODIFY THESE TERMS

Astrotouristing may review and modify these Terms at any time.

You will be subject to the policies and Terms in effect at the time you use this website or make each transaction, unless we are required by law or governmental authority to make retroactive changes to these policies, Terms, or privacy policy, in which case any changes will also apply to orders you have previously placed. 

DISCLAIMER OF LIABILITY

We will not be liable for any failure or delay in performing any of our obligations when such failure or delay is due to events beyond our reasonable control ("Force Majeure Event"). Force Majeure Events include any act, event, non-occurrence, omission, or accident beyond our reasonable control, including but not limited to the following:

(i)  Strikes, lockouts, or other industrial action.

(ii) Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (declared or undeclared), or threat or preparation for war.  

(iii) Fire, explosion, storm, flood, earthquake, subsidence, epidemic, or any other natural disaster. 

(iv) Impossibility of using railways, shipping, aircraft, motor transport, or other means of public or private transport. 

(v) Impossibility of using public or private telecommunications systems.  

(vi) Acts, decrees, legislation, regulations, or restrictions of any government or public authority. 

Our obligations shall be suspended for the duration of the Force Majeure Event, and we shall be granted an extension of time to perform such obligations for a period equal to the duration of the Force Majeure Event. We will use all reasonable means to bring the Force Majeure Event to an end or to find a solution that allows us to fulfill our obligations despite the Force Majeure Event. 

INTEGRITY

These Terms and Conditions and any documents expressly referred to herein constitute the entire agreement between you and us relating to their subject matter and supersede all prior agreements, understandings, or promises between you and us, whether oral or written.

You and we acknowledge that we have entered into this agreement without relying on any representation or promise made by the other party or that could be inferred from any statement or writing in the negotiations between us prior to this agreement, except as expressly stated in these Terms and Conditions.

Neither you nor we shall have any recourse against any inaccurate representation made by the other party, whether oral or written, prior to the date of this agreement (unless such inaccurate representation was made fraudulently), and the only recourse available to either party shall be for breach of contract as provided in these Terms and Conditions.

If any of these Terms and Conditions or any provision of a contract are declared null and void by a final decision issued by a competent authority, the remaining terms and conditions will remain in force, unaffected by said declaration of nullity.

JURISDICTION AND APPLICABLE LAW

The sale is deemed to have taken place in Spanish territory. Therefore, Spanish law will apply to any interpretative or legal issues that may arise. In the event of a dispute, both parties agree to submit,  expressly waiving any other jurisdiction that may apply, to the jurisdiction of the Courts of the Consumer's domicile.
